By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. SECTION 1 - ONLINE STORE TERMS

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age. 
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS 

We reserve the right to refuse Service to anyone for any reason at any time. 
You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission by us.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 3 - ORDER PROCESS

All orders that you place with us will be subject to acceptance in accordance with these Terms and Conditions. The 'confirmation' stage sets out the final details of your order. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance from us. Once we have received your order we will check the necessary information such as stock levels and pricing. Acceptance of your order and the completion of the contract between you and us will take place when we dispatch the products ordered, unless we have notified you that we are unable to accept your order or you have cancelled it.

SECTION 4 - PRODUCTS & BESPOKE ITEMS

Variations in imagery; We strive to represent products accurately, but colours can vary across screens, natural materials may show variations in grain and colour. Such characteristics do not constitute faults or defects. 

Measurements & accuracy; You are responsible for the accuracy of your measurements (for example, for carpets and vinyl) We offer general advice, but we cannot accept returns if your dimensions prove incorrect.

Checking your delivery; Please inspect products immediately upon delivery for any damage or discrepancies (type, colour, size, quantity). If there are any issues, contact us immediately. We keep records of shipment, including photos, courier proof, and GPS data, so we can verify claims. Once you cut, fit, or modify the products, you confirm your acceptance of their condition. Any problems found after fitting are considered 'fitted complaints.' We will liaise with the manufacturer on your behalf, but the final decision rests with them.

Bespoke & customised products; Products that are cut to size, or made to order cannot be returned or cancelled under normal distance-selling rules if you change your mind. Should you suspect a manufacturing defect, please provide evidence; we will work with you and the manufacturer to resolve the matter.

Out of stock products

Every effort is made to ensure that all our products shown are in stock and in the unlikely event a product is chosen, that then is found to be out of stock, you will be contacted in regards to other alternatives & upgrades available or a full refund. We offer no guarantee of availability. 

SECTION 5 - PRICE

The price you pay is the price displayed on the product page of this website for your specified size(s) at the time we receive your order. While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Payment can be made by PayPal or debit/ credit cards. Ownership to any products you order with us shall pass to you on delivery of the products provided that we have processed and received payment in full for the products. All prices are shown in £ sterling and include VAT (where applicable) at the current rates and include the delivery charges, unless stated otherwise.

SECTION 6 - PAYMENT 

We accept various payment methods, including Credit/Debit Cards, PayPal, Apple Pay, Google Pay and Klarna. Payment must clear in full before dispatch. We retain title to the Products until payment is cleared in full. You assume the risk (loss or damage) once the Products are delivered.

Changes to orders; If you wish to change product type, quantity, delivery details, or similar, please contact us immediately. We will advise if this is feasible and inform you of any impact on cost or timing.

SECTION 7 - DELIVERY

All goods must be signed for by an adult aged 18 years or over upon delivery. Delivery charges and estimated timescales are specified in the Delivery Information section. We make every effort to deliver goods within the estimated timescales, however delays are occasionally inevitable due to unforeseen factors, and deliveries of multiple items may arrive on separate days or on different deliveries. We are under no liability for any delay or failure to deliver the products within the estimated timescales. Risk of loss and damage of products passes to you on the date when the products are delivered or the date that the first delivery is attempted by us. In some circumstances a product being delivered may be heavier than the driver is able to lift. In these cases it is a customer’s responsibility to ensure that they have sufficient equipment and personnel available at the point of delivery to assist with unloading or, alternatively be able to provide smaller cut down sizes for the product ordered that can be delivered to the doorstep and unloaded without assistance. We will notify you of heavy products before delivery.  Please note that we strongly advise that you do not book your fitter until you have received and checked your order, as we are not liable for any installation costs or lost wages.

SECTION 8 - RETURNS & CANCELLATIONS

When ordering from us you can return your order up to 14 days after receiving your order. Some products are excluded from this policy for example items which are cut to your bespoke size. Distance Sales & Cooling-Off: Non-bespoke Products typically include a 14-day cooling-off period, starting the day after delivery. Bespoke items (e.g., custom vinyl/carpet cuts) are exempt.

Should you request to cancel your order, customers have a 12-hour period after placing the order to notify us of any cancellations or amendments.  Unfortunately after this 12-hour window, no amendments or cancellations can be approved after your order has begun processing and sent to the warehouse to be cut. 

All items must be returned in the same packaging and condition in which they were received by you. In the unlikely event that you receive faulty or damaged goods, please contact us ASAP and within 48 hours, prior to cutting and/or fitting the product(s) and we will arrange for the faulty or damaged goods to be collected and replaced. Unfortunately if any ordered item is removed from it's original condition (for example cut and fitted) we will be unable to replace or give a full refund for the product(s). Please see our Refunds Policy.

For collections we do require that the product is well wrapped ready for transit. The collection is from the nearest kerbside of the property and the driver may need help loading if the collection item is heavy. If the item is not wrapped or you are unable to bring it out to the kerbside at the time of collection the collection may not be completed.  

SECTION 9 - CARPET & FLOORING SPECIFIC CONDITIONS OF SALE

When you receive your order, please remove all packaging and thoroughly check the ordered product(s) before booking your fitter to ensure it is the correct size and colour as you expected, and free from damage and/or defects. Once you have cut into and/or fitted the item, you are the owner and we cannot be held responsible for any exchanges or fitting costs. Packaging and the product itself can include staples or sharp objects. Please ensure that you or your fitter have checked the product thoroughly for such items and removed all such packaging with care before securing the product(s) for everyday usage. We cannot be held liable for any injuries incurred by anyone where product(s) purchased have been installed without being thoroughly checked for sharp objects prior to or during the installation process. Please note, we are unable to guarantee an exact colour match on different rolls. If an exact colour match is required please contact us at the time of ordering and we will do all that we can to help. An exact colour match is especially hard to achieve when different widths have been used, or the flooring has been ordered on different dates. 

Like other textiles, carpet has certain inherent characteristics that may affect its appearance. These are normal and are not considered to be manufacturing faults or defects. These are: Shading/Pile reversal/Sprouting yarn/Shedding/Roll pressure marks.

All pile carpets, are liable (after they have been in use for some time) to shading, i.e. to show light and dark patched areas. All characteristics are inherent in all pile fabrics and therefore we cannot accept any responsibility for complaints arising from any of these causes.

Colour Disclaimer
Due to monitor settings, monitor pixel definitions, limitations of desktop scanners, digital photography etc, we cannot guarantee that the colour you see on your screen as an exact colour of the product. We strive to make our colours as accurate as possible, but screen images are intended as a guide only and should not be regarded as absolutely correct. All colours are approximations of actual colours.

SECTION 10 - IF YOU HAVE PROBLEMS WITH YOUR PRODUCTS

10.1 Reporting Faults or Complaints

  • Contact Us: Email cesccarpets@gmail.com. promptly if you notice any damage, faults, or missing items.
  • Notification Window: We recommend alerting us within 48 hours of delivery for damaged or faulty products. We will arrange collection and replacement at our expense if the fault is confirmed genuine.

10.2 Consumer Rights & Legal Protections

  • Statutory Rights: Products should match their description, be of satisfactory quality, and fit for purpose.
  • Distance Sales & Cooling-Off: Non-bespoke Goods typically include a 14-day cooling-off period, starting the day after delivery. Bespoke items (e.g., custom vinyl/carpet cuts) are exempt.

10.3 Returning Unwanted Goods

  • Eligibility: Unused, unopened, and resalable condition is required.
  • Exclusions: Discontinued products, cut-from-roll vinyl or carpet, accessories, cannot be returned unless faulty on arrival.
  • Procedure: Notify us within 14 days, ship items back at your cost (unless we are at fault), and use an insured method. Damaged returns or items not in resalable condition may incur deductions or refusal.
  • Restocking Fee: If we permit returns against our usual policy, a restocking fee may apply.

10.4 Customer Responsibilities

  • Inspect Before Use: Once fitted or used, the product is deemed accepted.
  • Suitability: You are responsible for determining whether the product meets your needs.
  • Fitters & Timelines: Do not schedule fitters until your products arrive and are inspected; we do not compensate for any losses if deliveries are delayed.

SECTION 11 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice. 
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

SECTION 12 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. 

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 13 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 
You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new Services and/or features through the website (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

Certain content, products and Services available via our Service may include materials from third-parties. 
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or Services of third-parties.
We are not liable for any harm or damages related to the purchase or use of goods, Services, resources, content, or any other transactions made in connection with any third-party websites. We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 18 - LIMITATION OF LIABILITY 

We are not liable for losses if your chosen fitter or contractor cannot proceed because of late delivery. Arrange installation only after receiving and inspecting your Goods. You assume full responsibility for choosing an installer; we will not be held liable for third-party workmanship issues. Nothing in these Terms excludes our liability for death or personal injury caused by negligence, or for fraud. Otherwise, our liability for any claim typically does not exceed the price paid for the Products in question.

SECTION 19 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with English law.
